The High Court on Monday issued a ruling asking the government to explain why the removal of former national cricket team’s captain Faruque Ahmed from the Bangladesh Cricket Board should not be declared illegal.

The vacation bench of Justice Razik-Al-Jalil and Justice Shathika Hossain also ordered a status quo on the operation of the BCB board of directors, meaning there would be no bar to former national team captain Aminul Islam functioning as the new BCB president for now.


The ruling came in response to a writ petition filed by Faruque Ahmed, who challenged the legality of his removal as a BCB director on Thursday.

Earlier on Monday, another High Court bench dropped Faruque’s petition from the cause list following strong opposition from attorney general Md Asaduzzaman.

The AG argued that Faruque bypassed the appropriate appellate remedy available under the Ministry of Youth and Sports through the National Sports Council before approaching the court.

He further contended that Aminul Islam Bulbul’s appointment as a BCB director followed the same procedure that was used in Faruque’s own appointment.

However, Faruque’s counsel, Ruhul Quddus Kazal, argued that Aminul Islam was elected BCB president on Friday through an unlawful process.

He claimed that the National Sports Council nominated Aminul as a councillor and then a director, in violation of the BCB constitution.

Kazal maintained that the council overstepped its jurisdiction as it bypassed the BCB’s internal governance process.

‘The NSC has no authority to unilaterally nominate or alter councillors; such decisions must be made in accordance with the BCB constitution and from the list approved by the board,’ he told the court.

Additional attorney general Aneek R Haque presented the NSC, while Nasiruddin Ahmed Ashim appeared for BCB.
