The High Court on Wednesday asked for separate statements from the trial court judge, jailors, the offender, and his lawyers over an allegation of detaining an innocent youth to jail instead of a convict, Awami Juba League leader Nazmul Hasan.

The High Court asked Dhaka 8th Additional Metropolitan District and Sessions judge M Morshed Alam to explain in seven days how he identified Mirajul Islam, who on September 1, 2023, surrendered to the court, instead of the actual offender Nazmul Hasan, as the actual convict in a narcotics case.

The High Court also asked the lawyers concerned, Nazrul Islam and Ariful Islam, to explain in seven days the facts that led to the wrongful detention of an innocent.

The HC further asked the superintendent of the Dhaka Central Jail to explain in seven days what procedure he followed to receive the accused in jail from the court.

The HC asked Dhaka Central Jail’s deputy jailor, Syed Hasan Ali, to explain in seven days how he verified the signature of the actual offender, Nazmul Hasan.

The HC asked Nazmul Hasan to submit a written statement in seven days through his lawyer, Mohammad Ramjan Khan, about the allegation published in the media that instead of him, innocent Mirajul Islam has been detained in jail.

The report said that Nazmul’s promise to pay huge money to Miraul for that purpose was not met.

The bench of Justice Md Ashraful Kamal issued the directives and set May 7 for passing further orders in the wrongful detention case.

On February 15, the High Court ordered a probe into a report titled ‘Juba League leader’s fraudulence practice in a narcotics case’ published by Dainik Kalbela on the day.

Supreme Court lawyer Manzill Murshid drew the attention of the court to the report stating that 23-year-old Mirajul Islam of Phulpur in Mymensingh had landed in jail instead of Nazmul.

Dhaka Additional Metropolitan Sessions Judge’s Court 8 sentenced Nazmul, 32, to seven years in jail in a narcotics case on July 4, 2023.
