The High Court on Sunday ruled that the Bangladesh Road Transport Authority cannot demand fees from vehicle owners for displaying advertisements on the body of the vehicles.
The vehicle owners, however, are required to get prior permission from the authority for displaying any advertisements on the body of the vehicles, according to the verdict.
The bench of Justice Naima Haider and Justice Kazi Zinat Hoque pronounced the verdict after hearing a writ petition filed by Kazi Food Industries Limited managing director Kazi Zahin Shahpar Hasan challenging the legality of a BRTA rule.
The rule provides that Tk 3,000 fee is required for displaying advertisements on the body of a light vehicle while Tk 5,000 fee is needed for displaying advertisements on the body of each heavy vehicle.
The court also declared illegal rule 122 of the Road Transport Rules 2022 for imposing the fees.
Kazi Food Industries Limited has 68 vehicles displaying advertisements of its products since the company鈥檚 inception in 2011, the petitioner鈥檚 lawyer Ahsanul Karim told 抖阴精品.
The road transport authority imposed fees for displaying advertisements on the vehicles framing a rule in 2022 although there was no such provision in the Motor Vehicle Ordinance 1983, he added.
BRTA lawyer Rafiul Islam said that the provision of fees for displaying advertisements on the body of vehicles was included in the Road Transport Act 2022 considering the need of time.
He said that the authority would appeal in the Appellate Division challenging the High Court verdict.
