
The High Court on Monday dropped from its cause list a writ petition filed by the former president of the Bangladesh Cricket Board, Faruque Ahmed, challenging the legality of his removal as a director of the board.
The bench of Justice Kazi Zinat Hoque and Justice Aynun Nahar Siddiqua allowed Faruque to move the petition before another bench.
The court dropped Faruque鈥檚 petition from the hearing list after the attorney general, Md Asaduzzaman, strongly opposed it, arguing that Faruque had approached the High Court without first exhausting the appellate remedy available under the sports branch of the ministry of youth and sports through the National Sports Council.
He further contended that former captain Aminul Islam was appointed as a BCB director through the same procedure that had been followed in Faruque鈥檚 own appointment.
Faruque filed the writ petition on Sunday, seeking a stay on the NSC鈥檚 May 29 decision that cancelled his appointment as a director of the BCB and on the subsequent appointment of Aminul in his place.
Aminul was elected as the president of the BCB on Friday after the NSC had nominated him as a councillor and then a director.听
In the petition, Faruque argued that the NSC had overstepped its authority by bypassing the provisions of the BCB constitution.
He contended that the NSC cannot alter or nominate a councillor independently, as such power lies strictly within the framework of the BCB constitution.
Faruque further stated that the NSC had unlawfully usurped BCB鈥檚 internal authority by appointing a councillor without selecting from the approved list submitted by the BCB.听
He also argued that Aminul鈥檚 nomination was not legally valid under the BCB constitution, adding that a person cannot be appointed as a BCB director or president without being duly elected as per the rules.
Pro-BNP lawyer Nasir Uddin Asim represented the BCB, while Faruque was represented by fellow pro-BNP lawyers Kayser Kamal and Ruhul Quddus Kazal.
