
The president on Monday gave approval to the Bangladesh Judicial Service Formation Rules, 2025, that stated that 25 per cent officials in law and judiciary would be appointed outside from members of Bangladesh judicial service.
Another Rules for Posting in the Law and Justice Division, 2025, was also approved by the president that transferred the authority to create judicial positions from the executive department to a committee, headed by the senior-most judge of the Appellate Division of the Supreme Court.
Following the approval of the president, two separate gazettes issued on Monday, said law ministry鈥檚 public relations officer Rezaul Karim.
According to the Rules for Posting in the Law and Justice Division, 2025, a committee headed by the senior-most judge of the Appellate Division which also includes judges from both divisions of the Supreme Court and secretaries from the public administration, finance, and law ministries, will make recommendations regarding the creation of judicial posts.
The judiciary will no longer need to seek approval from the public administration or finance ministries for creating new positions.
The rules stated that members of the judicial service would be appointed in different posts of law and justice divisions.
However, 25 per cent in the posts of assistant secretary, senior assistant secretary, deputy secretary, joint secretary and additional secretary can be appointed outside the officials of the judicial service. But the public administration will have to take consent from the Law and Justice Division before issuing any order regarding such appointment.

Law and justice division will have to issue any order regarding appointments of the Law secretary and additional secretary with consultation of Supreme Court and following approval from the president.
The new formation rules clearly list the judicial and administrative posts under the Judicial Service, categorising them separately to streamline the organisational structure.
New recruits will serve a two-year probationary period before confirmation, subjected to satisfactory performance, said the rules.
In cases of suspension, dismissal, or removal, the Bangladesh Judicial Service (Discipline) Rules, 2017, will be applicable, and consultation with the Supreme Court is mandatory.
