Kanu Miah, a mentally disabled man, finally returned home on Tuesday noon after passing more than 30 years in Habiganj District Jail without trial in a murder case.

Kanu Miah is son of late Chini Miah of Singhagram village at Lakhai upazila in Habiganj, court sources said.


Habiganj public prosecutor Md Abdul Hai confirmed the release of Kanu Miah to ¶¶Òõ¾«Æ· in the afternoon.

He said that Legal Aid’s panel lawyer MA Majid submitted a bail plea for Kanu Miah to the Habiganj District And Session’s Judge Court on Monday and the judge Jasmine Ara Begum granted the bail prayer after holding a hearing on the petition.

‘Following the court order, prisoner Kanu Miah was released from the prison on Tuesday noon when his two brothers — Manu Maih and Nasu Miah — received him at the jail gate,’ the PP said.  

He said that the two brothers hugged Kanu at that moment and none of them could contain their tears as they met with each other again after 30 years 2 months and 19 days.

Recently, Habiganj District Legal Aid officer and senior assistant judge Muhammad Abbas Uddin brought the matter to the attention of the court.

He contacted the plaintiffs in the case — Manu Miah and Nasu Miam, and started the bail process of Kanu with their cooperation, the court sources said.

According to the case story in brief, mentally imbalanced Kanu hacked his mother with a spade to death in the night of May 25 in 1995 while she was sleeping.

Police arrested Kanu from the spot immediately after the killing incident and he was produced before the erstwhile Habiganj sub-divisional court on the next day of the incident when he had given a very brief confessional statement about his crime. 

Later, the judicial proceedings in the case were suspended due to mental imbalance of the lone accused following an order issued by the High Court. As a result, Kanu passed years after years in the prison without trial, the court sources said.

Habiganj court public prosecutor expressed his gratitude to the Legal Aid officer and the lawyers concerned for bringing the matter in light and taking steps for the victim’s bail with a humanitarian consideration.
